Those who have seen this secret plan say it will impose sweeping changes over how the internet operates. It will slow down broadband speeds, create a new federal department to spy on your online activities and it will allow federal and state governments to tax your internet use as a public utility.

We do not know everything that this plan will do if it is enacted, because no one in the public is allowed to see it!

This is a violation of the Administrative Procedure Act (APA) of 1946. This Act was passed as a "bill of rights" to protect Americans from the possibility of newly-created federal agencies (new in 1946) having the power to pass regulations that impact our lives.

Under the APA, federal agencies including the FCC must provide for public participation in the rulemaking process. For the FCC, this means the agency must post proposed rule changes in the Federal Register AND allow a public comment period of AT LEAST 30 days before voting.

Obama's plan was drafted in secrecy and you have not been allowed a chance to read or comment on these rule changes, even though they will have a massive impact on how you are able to use the internet.

Obama's FCC internet takeover plan is completely ILLEGAL under federal law. Therefore, you must speak out today to prevent this vote from happening!

Dear FCC Chairman Wheeler:

By attempting to pass sweeping rule changes related to broadband internet connections without allowing public participation through a public comment period, the FCC is violating the Administrative Procedure Act (APA) of 1946 (Pub.L. 79-404, 60 Stat. 237). The APA was passed as a "bill of rights" to protect American citizens from being abused by federal agencies.

The FCC's own rules state that in order to comply with the APA, proposed rule changes must allow a minimum 30-day public comment period AFTER those rule changes have been published in the Federal Register.

This plan was released to FCC Commissioners three weeks ago and it was not published in the Federal Register. It is being kept secret and the public is being kept in the dark as to the contents of this plan, which will impact the lives of nearly every single American.

I am also disturbed by the fact that one FCC Commissioner has publicly stated that this is "President Obama's plan." That would also be a violation of federal law, as the Executive Branch is not allowed to have undue influence on proposed rule changes.

Given the fact that the FCC is clearly violating my rights under the APA, I demand that you stop the vote on Thursday, February 26th. This plan must be published in the Federal Register and a 30-day public comment period must be allowed prior to any vote being taken. Again, the law is clearly being broken by the process through which the FCC is undertaking this vote, and "we the people" will follow up by demanding justice for this abuse of our rights.
