A treaty is a legally binding agreement between two or more countries. The Transpacific Partnership is a legally binding trade agreement between 12 countries.

Under Trade Promotion Authority (fast track) passed by Congress last year, the TPP can be approved by a simple majority vote in the House and Senate.

The Treaty Clause of the US Constitution has never been amended, which requires a two-thirds vote for ratification in the Senate.

So why is Congress allowed to do this?

Because this is how NAFTA was approved by Bill Clinton!

The North American Free Trade Agreement failed to reach 67 votes for ratification in the Senate, so Trade Promotion Authority was used to require a simple majority vote bypassing the two-thirds requirement.

When groups sued the federal government over the unconstitutional passage of NAFTA, the federal courts refused to hear the case - so this question has never been decided by the courts.

This is how we can stall and beat the TPP forces trying to flood America with foreign workers.

If we can convince several Members of Congress to submit the question to the lawyers at the House Office of Legislative Counsel for a review, it could delay passage of the TPP until it's too late for this Congress and Obama to shove it down America's throat!

Dear Chairman Meadows:

Under the Treaty Clause of the United States Constitution, a treaty can only be ratified under the advice and consent of the Senate and only after passing a two-thirds vote threshold. I am confused as to why the Transpacific Partnership is being treated differently than this, since the Treaty Clause has never been amended. The TPP is clearly a treaty because it is a legally binding agreement between a dozen nations and it will be binding on future presidents. It meets every threshold for the legal definition of a treaty.

The North American Free Trade Agreement was ratified as a treaty by the Mexican government, under the rules of the Mexican constitution. Yet when NAFTA failed to meet the two-thirds required vote in the US Senate, it was shuffled through Congress on a simple majority vote under Trade Promotion Authority. At the time, federal courts refused to hear the case that was brought by Americans challenging the constitutionality of the way NAFTA was passed. Therefore the constitutionality of approving a treaty with a simple majority vote has never been decided by the courts.

I am not a constitutional scholar, but "Bill Clinton did it one time!" does not seem like a valid basis to amend the US Constitution. So I am seeking legal clarification before you move forward with the Transpacific Partnership treaty under Trade Promotion Authority rules. I urge you to request clarification from the Office of Legislative Counsel on this issue.

Please ask the Office of Legislative Counsel this question: Is it constitutional and legal to ratify the Transpacific Partnership trade treaty with a simple majority vote? Tell the attorneys to take their time in searching out an answer, preferably until January 20, 2017. Once you have a response, please publicize the legal justification so all of your constituents and the rest of America can understand this process. There does not seem to be legal justification for passing a treaty with a simple majority vote and we are all eagerly awaiting an answer to this question. You should also point out to congressional leadership that no vote should be taken on the TPP until after this question has been sufficiently answered.
