Congressman Louie Gohmert (R-TX) is a former judge and he has a great plan to stop the activist appeals courts from blocking President Trump's efforts to protect America's borders.

The plan is simple:  Congress created all of the federal appeals courts and therefore, Congress can strip jurisdiction away from these courts on any or all issues!

This plan would prevent every one of Bill Clinton and Barack Obama's activist judges on the appeals courts from blocking any more of the President's constitutional protection orders.

Appearing on Fox News on June 4, Rep. Gohmert stated, "At a minimum, we in Congress have got to make clear – we created those courts – every one except the Supreme Court – and we can take this travel ban issue right out from under their jurisdiction. They have no business ruling on that."1

Congressman Gohmert is a champion of American freedom and he is absolutely correct!

Two separate Obama-appointed appeals court judges blocked two separate temporary travel bans from the President that were designed to save American lives from invading Muslim terrorists who enter our country on a daily basis by posing as "refugees."

How can a single unelected judge on an appeals court in Seattle, San Francisco or Hawaii set immigration policy for our entire nation? This is crazy!

Congress created the appeals courts - even the loony Ninth Circuit Court of Appeals which cannot find the Constitution with both hands and a flashlight - and Congress has authority to strip jurisdiction away from those courts.

As James Madison, the "Father of the Constitution" stated, "In republican government, the legislative authority necessarily predominates."2

The judges are now making rulings based on emotion rather than on the Constitution, American established case law or even common sense.

It is time to rein these courts in. They are NOT the highest authority in the land but many people - including many Members of Congress - now mistakenly believe that the courts are the final authority on all matters.

Congress gave jurisdiction over immigration matters to the courts and it can take it away! Congress could even create a new separate immigration court (fully staffed by President Trump's appointees) to handle all cases related to immigration.

This is a case of the creation exalting itself over its creator. Isaiah 29:16 states, "Shall the potter be esteemed as the clay; for shall the thing made say of him who made it, 'He did not make me'?
Or shall the thing formed say of him who formed it,
"He has no understanding.' "

The courts cannot overrule the American people and Congress any more than the clay can overrule the potter!

Dear Chairman Goodlatte:

The American people elected President Trump because we support his agenda to ensure the safety and security of our nation. To that end, we the people are angry that lone activist judges on the federal appeals courts have been blocking the President's common sense immigration protection orders. To that end, I hope that you will support an effort to strip jurisdiction over immigration cases away from the federal circuit appeals courts.

These judges are no longer ruling on cases based on the Constitution and the rule of law. They are issuing rulings based on foreign case law, Sharia law and even on their own fragile emotions. Our nation cannot survive intact if we allow this judicial activism to continue. The federal appeals courts had no business even hearing the cases brought against President Trump's immigration policies.

What many Members of Congress have forgotten is that the courts are not the final authority on laws in the United States. The legislative branch has tremendous authority and as James Madison, the Father of the Constitution stated, "In republican government, the legislative authority necessarily predominates."

The federal circuit appeals courts were created by Congress and therefore Congress has authority over those courts. You have the power to abolish the courts entirely, create new ones or alter their jurisdiction. This is a simple fix to a massive problem and indeed, a national security threat. When a lone judge in Seattle or San Francisco can set the entire nation's immigration policy by overruling the President, Congress and the Constitution, we are all endangered by this.

Judicial activism is now rampant after eight years of the Obama administration appointing its radical political allies to seats on the bench. It is truly unfortunate that Congress rubber-stamped many of those appointees, including one person who had never set foot in a courtroom, but that is what has left us in this situation.

The best solution seems to be to rein in the courts. This can be through a simple Act of Congress by which you strip jurisdiction over immigration cases away from the federal appeals courts. You could even create a new immigration court to hear those cases and it could be 100% staffed by President Trump's appointees. The courts are out of control and it is time to rein them in!
