Senate bill 36 (S. 36) would close a 2001 loophole created by a little-known Supreme Court case (Zadvyas v. Davis) that has released hundreds of thousands of violent illegal aliens from custody instead of deporting them.1 (see footnote for link)

Now that we have a conservative majority on the Supreme Court, any challenge to S. 36 if it becomes law can be defeated and we can stop criminal aliens from being released on a technicality to victimize more Americans.

But first we must get S. 36 passed in the US Senate where it has been stalled since January.

Close the Zadvyas Loophole!

You must contact the Senate GOP and persuade the Senators to support and pass S. 36 which will correct a grievous wrong that a liberal Supreme Court majority inflicted on America!

The Zadvydas v. Davis decision in 2001 was the seminal case that started the flood of criminal illegal aliens under deportation orders being released back onto the streets in America.2 (see footnote for link)

Kestutis Zadvydas was a convicted cocaine dealer and an illegal alien. He was Lithuanian by birth but born in Germany. No country wanted to take this guy back when he was ordered deported, so the Attorney General under the law at the time kept Zadvydas detained until the government could find a place to ship him.

The ACLU and other groups sued, arguing that Zadvydas' due process rights were being violated because he had been in custody awaiting deportation more than 90 days.

A left-leaning Supreme Court in 2001 decided in favor of Zadvydas 5-4. The late Justice Antonin Scalia argued in the dissension that due process does not confer the right to any alien to remain in the US against the national will.

Thanks to the Zadvydas Loophole as it is now known, violent illegal alien convicts are now released directly onto the streets of American cities if their taxpayer-funded immigration lawyer can stall their deportation for 91 days!

In the first three years after the Zadvydas decision, 134,000 aliens under final deportation orders were released back into American cities. Hundreds of thousands of aliens who should have been deported are now roaming free simply because their  home countries refused to take them back!

This includes the following aliens:

  • Binh Thai Luc, a Vietnamese thief who murdered five people in San Francisco AFTER he was released under the Zadvydas Loophole.
  • Abdulahi Hasan Sharif, a suspected Somali terrorist who stabbed a police officer and ran four pedestrians over with his car after being released.
  • Kesler Dufrene, a Haitian illegal alien who murdered three people in Miami after being released from custody.

S. 36 closes the Zadvydas Loophole by allowing the indefinite detention of aliens who are a danger to the community until they can be deported, including terrorists and aliens with dangerous communicable diseases.

Proverbs 24:24 states, "He who says to the wicked, 'You are righteous,' will be cursed by the people. Nations will despise him."

The Zadvydas Loophole declares the worst aliens imaginable to be innocent and releases them if they simply stay locked up past an arbitrary 90-day time frame. This is not justice!

Contact the Republicans in Congress using the form to the right and tell them close the Zadvydas Loophole by supporting and passing S. 36!

The 2001 Supreme Court case Zadvydas v. Davis created a loophole by which hundreds of thousands of criminal aliens have been released from custody as they were awaiting deportation orders. The sole reason these aliens are released from custody is because their home countries refuse to take them back. Senate bill 36, the Keep Our Communities Safe Act, seeks to close the Zadvydas Loophole. You will find a link at the bottom of this message from Pray For US which provides supporting background information on this issue.

Kestutis Zadvydas was a convicted cocaine dealer who was born in Germany to Lithuanian parents. He was detained longer than 90 days in 1994 because no country wanted to take him back after he was ordered deported. The Supreme Court wrongly ruled in a 5-4 liberal decision that it somehow violates the due process rights of criminal aliens if they are detained more than 90 days.

More than 134,000 criminal aliens awaiting deportation were turned loose into American communities between 2001 and 2004. Hundreds of thousands of criminal aliens receive a get-out-of-deportation-free card if their immigration lawyer can keep them in the system past the 90-day threshold. This is an insane policy and it has gotten numerous Americans killed.

Binh Thai Luc killed five people in San Francisco after his home country of Vietnam refused to take him back. Abdulahi Hasan Sharif is a suspected Islamic terrorist who ran over four pedestrians and stabbed a police officer after he could not be deported to Somalia. Kesler Dufrene murdered three people in Miami when he could not be deported back to his home country of Haiti. These are just a few of the thousands upon thousands of violent aliens under deportation orders who have been released because of the Zadvydas Loophole.

I urge you to support and pass S. 36 to finally close the Zadvydas Loophole. Now that we have a conservative majority on the Supreme Court, the law will surely withstand the predictable court challenge from the ACLU. It is inexcusable that the government releases hundreds of thousands of criminal aliens into our communities simply because they pass a 90-day threshold. They need to stay in custody until the government finds a suitable new home for them OUTSIDE of the United States!
